DaVita
DaVita — Dialysis chain — VA community care · davita.com.
What it sells
DaVita is one of the two chains that dominate American dialysis — together with Fresenius, roughly 74% of the U.S. market per HHS’s 2026 kidney plan — and a major VA community-care dialysis provider. The VA spent about $1.2 billion on community dialysis across ALL providers from Oct 2020 through Sep 2022 (VA OIG); no DaVita-only VA total was found in this build’s research, and none is invented here.
The contract and the money
VA community dialysis runs through the Community Care Network and the Nationwide Dialysis Services Contracts — the arrangements the VA OIG audited (below).
- $538 million — paid BY the VA TO DaVita (2017 settlement) — This was a settlement of DaVita’s lawsuit claiming VA UNDERPAID it for dialysis services 2005–2011 — money the VA paid the company on top of its contract billings, reported here as what it was. (Modern Healthcare, Feb 3, 2017)
- About $1.2 billion (VA community dialysis, ALL providers, Oct 2020–Sep 2022) — Context figure — not a DaVita figure. (VA OIG community dialysis audit)
On the record
What the government’s own watchdogs and prosecutors have published about this company, newest first. The summaries are ours; the findings are theirs.
- DaVita to Pay $450 Million to Resolve Allegations It Sought Reimbursement for Unnecessary Drug Waste (DOJ) (2015-06-24) — DOJ: DaVita resolved False Claims Act allegations that it knowingly created unnecessary waste administering Zemplar and Venofer to dialysis patients and billed the government for the avoidable waste.
- VA OIG: VA Needs to Improve Community Dialysis Oversight and Align Future Contracts with the MISSION Act — A VA-wide finding, not a DaVita-specific one: nationwide dialysis contract providers were paid more than the Medicare rate, oversight and referral compliance were weak, and future contracts must meet MISSION Act rate limits. (The OIG’s separate Sept 19, 2024 audit of an UNNAMED dialysis provider’s billing — 1,212 incorrect claims, almost $6.4M — is not attributed to DaVita, because the OIG did not name it.)
